Does Lindsay Lohan Have a "Get Out of Jail Free" Card?

Does Lindsay Lohan Have a "Get Out of Jail Free" Card?

Now that Lindsay Lohan is being tried for felony grand theft, there's a distinct possibility that she's headed back to jail. Or is there? The 24-year-old actress seems convinced that she can walk away from this scandal without an orange jumpsuit on. Here are three scenarios in which Lohan, who has pleaded not guilty, could avoid jail time.

1. She convinces the jury that it was a misunderstanding. Lohan claims to genuinely believe that the $2500 necklace was a loan, declaring on Twitter that she "would never steal." There are reportedly some holes in the jewelry store's side of the story, and if Lohan's lawyers can establish reasonable doubt, the jury could side with Lohan.

2. She makes a plea deal without going to trial. Lohan's lawyers could try to make her a deal to get felony probation with no jail time, on the condition that she stays out of trouble for three years. (What are the odds of that happening?) Celebrities like Charlie Sheen have used plea deals to get out of jail in the recent past, especially when judges want to avoid a media circus.

3. The felony charge could be reduced. Lohan's lawyer is already arguing that the necklace she allegedly stole is worth only $800-$1000, much less than the jewelry store claims. If that's true, the theft would be a misdemeanor rather than a felony -- and it would reduce Lindsay's possible sentence from three-and-a-half years to six months. However, an LAPD detective told E! that the value of the necklace will probably be whatever the store was charging.

While they prepare for the next hearing on February 23rd, the Lohans are playing their usual blame game with the media. According to People, Lindsay "really, truly believes she didn't do anything wrong" and thinks she's being charged because "people are just out to get her." Her father Michael Lohan has declared that this whole thing is her managers' fault. And mother Dina Lohan says that Lindsay is "all good" and that "God has a big plan" for her daughter.
